The Briefline Terms and Conditions

§1. General provisions
  1. These Terms and Conditions define the rules for using the website The Briefline, available at https://www.thebriefline.com (hereinafter referred to as the “Service”).
  2. The administrator of the Service is OXCOM Systems, with its registered office in Warsaw, Grzybowska 87 (hereinafter referred to as the “Administrator”).
  3. These Terms and Conditions constitute the regulations for the provision of electronic services within the meaning of the Act of 18 July 2002 on the provision of electronic services.
  4. The Terms and Conditions are made available to the User free of charge prior to the conclusion of the agreement, in a form enabling their saving, reproduction and storage.
  5. Use of the Service, including the creation of an Account or the purchase of a Subscription, constitutes acceptance of these Terms and Conditions.
§2. Definitions

For the purposes of these Terms and Conditions, the following definitions shall apply:

  1. User – a natural person using the Service.
  2. Account – an individual User account created within the Service.
  3. Subscription – paid, renewable access to the Content of the Service, offered under subscription plans.
  4. Content – informational materials published within the Service, in particular dispatches, briefings, communications and archives.
  5. MemberPress – the IT system used within the Service to manage Accounts, Subscriptions and payments.
§3. Scope of services
  1. The Administrator provides electronic services consisting of:
    a) providing access to informational Content,
    b) enabling the registration and maintenance of an Account,
    c) enabling the conclusion of Subscription agreements,
    d) sending email messages related to the operation of the Service, including briefings and technical communications.
  2. Some Content may be available free of charge, subject to time-based or functional limitations.
  3. Full and ongoing access to the Content requires an active Subscription.
§4. User Account
  1. Creating an Account is voluntary; however, it is necessary in order to purchase a Subscription.
  2. The User is obliged to provide accurate and up-to-date information.
  3. The User is responsible for maintaining the confidentiality of Account access credentials.
  4. The Administrator may suspend or delete an Account in the event of a breach of these Terms and Conditions or applicable laws.
§5. Subscriptions and payments
  1. The Service offers Subscriptions under subscription plans described each time on the Service’s website.
  2. Subscriptions are renewable unless the description of a given plan states otherwise.
  3. Access to Content under a Subscription is granted immediately after payment has been made.
  4. Payments are processed via payment systems integrated with MemberPress.
  5. The User may cancel the Subscription at any time via the Account settings. Cancellation stops further payments after the end of the current billing period.
  6. The fee for a commenced Subscription period is non-refundable, subject to mandatory provisions of applicable law.
  7. All prices indicated in the Service are gross prices and include value added tax (VAT) in accordance with applicable law.
  8. The sale of subscriptions is documented by a payment confirmation sent electronically.
  9. A VAT invoice shall be issued at the User’s request, submitted within the time limit provided by applicable law.
§6. Right of withdrawal
  1. A Consumer has the right to withdraw from a distance contract within 14 days from the date of its conclusion, in accordance with consumer protection laws.
  2. The right of withdrawal does not apply to digital services if:
    a) the provision of the service began before the expiry of the 14-day period,
    b) this occurred with the Consumer’s explicit consent,
    c) the Consumer was informed prior to concluding the contract that they would lose the right of withdrawal once the service had begun.
  3. Granting access to Content under a Subscription constitutes the commencement of service provision within the meaning of consumer protection laws.
§7. Rules of use of the Service
  1. The User is obliged to use the Service in accordance with the law, these Terms and Conditions and accepted standards of conduct.
  2. In particular, it is prohibited to:
    a) copy, distribute or use the Content for commercial purposes without the Administrator’s consent,
    b) share Account access with third parties,
    c) undertake actions that may disrupt the functioning of the Service or circumvent its technical safeguards.
§8. Copyright
  1. The Content published within the Service constitutes works protected by copyright law.
  2. Copyright to the Content is held by the Administrator or authorised third parties.
  3. The Content may be used solely within the scope of permitted personal use.
§9. Liability
  1. The Administrator exercises due diligence to ensure that the Content is reliable and up to date; however, it does not guarantee its completeness or suitability for any particular purpose.
  2. The Administrator shall not be liable for interruptions in the availability of the Service resulting from technical reasons, force majeure or actions of third parties.
§10. Complaints
  1. Complaints regarding the functioning of the Service may be submitted electronically to the following address: info@thebriefline.com.
  2. Complaints shall be reviewed within 14 days from the date of their receipt.
§11. Personal data protection
  1. The rules for the processing of personal data are set out in the Privacy Policy available within the Service.
  2. Personal data is processed in accordance with applicable laws, in particular the GDPR.
§12. Amendments to the Terms and Conditions
  1. The Administrator reserves the right to amend these Terms and Conditions for important legal, organisational or technical reasons.
  2. Amendments to the Terms and Conditions are published within the Service and take effect from the date specified by the Administrator.
§13. Final provisions
  1. These Terms and Conditions enter into force on the date of publication within the Service.
  2. Matters not regulated by these Terms and Conditions shall be governed by Polish law.
